Seller's Disclosures

Since we are looking for a truly "As-Is" sale, you need to disclose as much information to the buyers as possible and put all of your cards on the table so the buyers know what "As-Is" truly is.

This webpage includes everything you’ll need to prepare yourself for filling in your seller’s disclosures on-line using the Glide System, and signing all of the documents using the DocuSign electronic signature program via email.

Part 1 of 2: "The DIA, TDS, and SPQ Disclosures":
(Note: Probate Transactions do not require the TDS and SPQ disclosures)

The first way we disclose information about your home is by supplying the potential buyers with the three most important seller's disclosures, which are:

 

1) The Disclosure Information Advisory (DIA) (3 pages):
The DIA is simply your instruction guide on how to fill out the TDS and the SPQ.  Take a moment to review.

2) The Transfer Disclosure Statement (TDS) (3 pages):

The TDS is one of the most important disclosures in a real estate transaction. It requires sellers to provide buyers with a detailed overview of the property's condition, including known defects, repairs, and any issues that may affect the home's value or livability. This form helps buyers make an informed decision before purchasing the home.

 

3) The Seller Property Questionnaire (SPQ) (4 pages):

The SPQ expands on the TDS by asking sellers to provide additional details about the property’s history, including past repairs, neighborhood conditions, and any legal matters affecting the home. It ensures buyers have a complete picture of the property’s background.  

Your DIA, TDS, and SPQ will be filled out using the on-line GLIDE system, which will guide you through every question and give you tips along the way.

Seller's Disclosures are not difficult to complete, but they should be done when you have some time on your hands to focus.

BEFORE YOU DIVE INTO GLIDE, you may want to take some time to gather your thoughts about Section 7 and 8 of the SPQ as these questions take a bit more of your time to complete.  These two sections of the SPQ (7 & 8) are where the seller tells the buyers what you've done to your home over the years to increase its value and desirability and also the repairs that you have made over the years.  


An additional benefit of documenting all of the upgrades that you have done to your home over the years, is that it will help reduce your capital gains taxes that you may owe after the sale of your home. Lastly, this verbiage will help us with your home’s marketing materials.  
 

You can simply type bullet points and we will create a separate addendum to attach to your SPQ, or you can create a spreadsheet or document and send that to us via email.  You should include 1) the improvement and 2) the approximate year that those upgrades occured.  It's quite simple, but you'll need time to remember all of it.

 

One final note: You can only count ONE modification or upgrade.  For example, if you replaced the fence, roof, water heater, etc., multiple times, you should only mention the latest one.  You don't have to include the costs in sections 7 and 8, but it may be good for you to document those costs for your tax purposes.

​Part 2 of 2 "The Other Disclosures":

After you've completed the TDS and the SPQ using GLIDE (Congrats!!), we will combine those documents with the "other" disclosures that you will be reviewing and signing.  These other disclosures are mainly "buyer beware" documents and also need to be signed and submitted so that we can create the "Complete Seller's Disclosure Package".  I know, I know...  It's a LOT of paperwork..

Please keep in mind that this webpage includes every disclosure, but you and your home may not be required to complete every disclosure.  For instance, if you don't have a trust, then your DocuSign won't include the the Trust Advisory.  If your home doesn't have a fireplace, or it's not in a fire hazard zone, or doesn't have solar or its not in an HOA, then your DocuSign won't include those documents either.
